We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall WALKALINE, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Some countries, states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such countries, states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Product Warranty (applicable only to electronic products sold by WALKALINE: The warranty conditions are locally provided by WALKALINE SOLUTIONS INDIA PVT LTD in India and WALKALINE SDN BHD in Malaysia and do not apply to appliances acquired outside of India/Malaysia. In countries where WALKALINE does not operate and products are sold, it is increasingly the case that warranties cannot be issued. 

LIMITED WARRANTY

Subject to the terms and conditions set forth in this limited warranty, WALKALINE SOLUTIONS INDIA PVT LIMITED and WALKALINE SDN BHD. ("WALKALINE") hereby warrants to the original purchaser (the “Owner”) that each
  1. Tankless Electric Instant Water Heater and 
  2. Electronic On Demand Instant Water Heater Faucet (the “Heater”) shall not
  • leak due to defects in the Manufacturer’s materials and workmanship for a period of five (5) years from the date of purchase or
  • fail due to defects in the Manufacturer’s materials or workmanship for a period of One (1) years from the date of purchase.
As Owner’s sole and exclusive remedy for breach of the above warranty, WALKALINE shall, at the Manufacturer’s discretion, send replacement parts for local repair; retrieve the unit for repair, or replace the defective Heater with a replacement unit with comparable operating features. WALKALINE’s maximum liability under all circumstances shall be limited to the Owner’s purchase price for the Heater.
This limited warranty shall be the exclusive warranty made by the WALKALINE and is made in lieu of all other warranties, express or implied, whether written or oral, including, but not limited to warranties of merchantability and fitness for a particular purpose. WALKALINE shall not be liable for incidental, consequential or contingent damages or expenses arising directly or indirectly from any defect in the Heater or the use of the Heater.
WALKALINE shall not be liable for any water damage or other damage to property of Owner arising, directly or indirectly, from any defect in the Heater or the use of the Heater. WALKALINE alone is authorized to make all warranties related to the products sold by WALKALINE on Manufacturer’s behalf and no statement, warranty or guarantee made by any other party shall be binding on WALKALINE.
WALKALINE shall not be liable for any damage whatsoever relating to or caused by:
  1. any misuse or neglect of the Heater, any accident to the Heater, any alteration of the Heater, or any other unintended use;
  2. acts of God and circumstances over which WALKALINE has no control;
  3. installation of the Heater other than as directed by WALKALINE and other than in accordance with applicable building codes;
  4. failure to maintain the Heater or to operate the Heater in accordance with the WALKALINE and Manufacturer specifications;
  5. operation of the Heater under fluctuating water pressure or in the event the Heater is supplied with non-potable water, for any duration;
  6. improper installation and/or improper materials used by any installer and not relating to defects in parts or workmanship of WALKALINE;
  7. moving the Heater from its original location of installation;
  8. exposure to freezing conditions;
  9. water quality issues such as corrosive water, hard water, and water contaminated with pollutants or additives;
Should the owner wish to return the Heater to WALKALINE for repair or replacement under this warranty, Owner must first secure written authorization from WALKALINE. Owner shall demonstrate proof of purchase, including a purchase date, and shall be responsible for all removal and transportation costs. If Owner cannot demonstrate a purchase date this warranty shall be limited to the period beginning from the date of manufacture stamped on the Heater. WALKALINE reserves the right to deny warranty coverage upon WALKALINE’s examination of Heater. This warranty is restricted to the Owner and cannot be assigned.
Some States and Provinces do not allow the exclusion or limitation of certain warranties. In such cases, the limitations set forth herein may not apply to the Owner. In such cases this warranty shall be limited to the shortest period and lowest damage amounts allowed by law. This warranty gives you specific legal rights and you may also have other rights which vary from State to State or Province to Province.
Owner shall be responsible for all labor and other charges incurred in the removal or repair of the Heater in the field. Please also note that the Heater must be installed in such a manner that if any leak does occur, the flow of water from any leak will not damage the area in which it is installed.


14. SHIPPING, RENTAL, CANCELLATION, RETURN AND REFUND POLICY

At Walkaline, we are committed to providing efficient and reliable shipping services for all our customers.

Processing and Shipping Times:

  • Order Processing: Orders are processed within 1-2 business days. Delays may occur during peak periods.
  • Shipping Times:
    • Domestic (India & Malaysia): Standard free shipping takes 10-15 business days. and Express paid shipping take 3-7 business days
    • International: Shipping times may vary depending on the destination and carrier.

Shipping Costs:

  • Shipping charges are calculated at checkout based on the delivery location and package weight.

Delivery and Tracking:

  • Once shipped, you will receive a tracking number via email to monitor your order’s progress.
  • Orders can be delivered to home addresses, offices, or specified pick-up locations.

Issues with Delivery:

  • In case of delays or shipping errors, please contact our support team at support@walkaline.biz  We are committed to resolving any issues promptly.

International Shipping:

  • International shipping is available for select products. Customs duties and taxes may apply based on local regulations, which the customer is responsible for.

Refund General Policy:

  • Purchases may be canceled before shipment. Once shipped, orders must follow the return process.
  • Return requests must be initiated within 7 days of receiving the item.
  • Refunds will be processed within 24 working days after completing the return process. 
  • Credit card refunds will be done via transaction cancellation; other payments will be refunded via bank transfer.

Conditions for Returns:

  • Returns will be accepted if the item is defective or incorrect.
  • Return costs will be borne by the responsible party (i.e., seller for defective items, buyer for other reasons).
  • Products sold outside specific regions (e.g., India or Malaysia) may not be eligible for returns or warranty coverage.

15. INDEMNIFICATION

You agree to indemnify, defend and hold harmless WALKALINE and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.


16. SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.


17. TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).


18. ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.


19. GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Malaysia for WALKALINE SDN BHD and laws of India for WALKALINE SOLUTIONS INDIA PVT LTD. Users agree that any legal action or proceedings arising out of these Terms of Use or in connection with these Terms of Use may be brought exclusively in the competent courts/ tribunals having jurisdiction in Hyderabad /India for WALKALINE SOLUTIONS INDIA PVT LTD and Selangor or Kuala Lumpur for WALKALINE SDN BHD and irrevocably submit themselves to the jurisdiction of such courts/ tribunals.
